FAMOUS READING OUTDOORS LLC – EVENT ACCESS PERMIT

In consideration of payment by the undersigned (“Permit Holder”) of the amount of the fee for the Event and being permitted to access the Event Property (as defined below) in order to participate in the Event (as defined below) and intending to be legally bound, Famous Reading Outdoors, LLC (“FRO”) hereby grants the Permit Holder this Event Access Permit, and the Permit Holder accepts this Event Access Permit, on the following conditions:

  1. This Event Access Permit is valid for the Event Days only and for the Event Location as defined below.

  2. This Event Permit is only valid for the Permit Holder’s participation in   YAMAHA PROVEN OFF-ROAD DEMO  (“Event”) on the following dates and times: commencing at 8:00 am on Friday, August 16, 2024 and terminating at  5:00 pm on Saturday, August 17, 2024 ("Event Days") at the   FRO DARKWATER PARKING & TRAILS   (“Event Location”). For purposes of this Event Access Permit, “RAC” means Reading Anthracite Company.

  3. Event Access Permits are non-transferable and non-assignable. If FRO determines that this Event Access Permit has been used by any person other than the Permit Holder, this Event Access Permit shall be immediately terminated, and the Permit Holder will forfeit this Event Access Permit for the remainder of the Event Days. Further, the Permit Holder agrees that he or she will be banned from purchasing another Event Access Permit and/or Access Permit in the future. The Permit Holder understands and agrees that any person found to be using this Event Access Permit without signing for it and/or not during the Event Days and/or outside of the Event Location will be prosecuted under the laws of Pennsylvania and for trespassing on FRO leased property and/or property owned by Reading Anthracite Company (“RAC”). The Permit Holder is not permitted on any other property except for the Event Location.
  4. This Event Access Permit provides Permit Holder with permission to be on the Event Location during the Event Days and during the hours posted for the Event. The Permit Holder is not permitted on any other properties including but not limited to properties where there is active mining, haul roads, restricted areas or any other working facilities or any posted properties by FRO, RAC, and/or any other entity and/or marked on the maps of FRO. The Permit Holder must park in the designated parking areas as set forth by FRO for the Event and check in with the proper person for the Event. The Permit Holder must have this Event Access Permit always displayed on their dashboard of their vehicle; otherwise, any vehicle without a valid Event Access Permit will be towed at the Permit Holder’s sole cost and expense. The Permit Holder must always have a separate permit from FRO on them, which must be visible on the Permit Holder and/or any off-road vehicle they are operating on the Event Location. The Permit Holder agrees that he or she may not enter the Event Location except for the hours posted for the Event. Event Access Permit does not grant Permit Holder access and/or any rights to enter onto any other property owned and/or leased by FRO, RAC, and/or any other entity and/or person(s).
  5. Permission is granted only for the Event and for Event activities. Further, the Permit Holder agrees that the use of alcohol, drugs and controlled substances at the Event Location is strictly prohibited. The Permit Holder agrees that he or she shall not be under the influence of any alcohol, drugs and controlled substances while at the Event Location.
  6. If the Permit Holder desires to take any type of licensed vehicle on the Event Location and/or for purposes of participating in the Event, the Permit Holder must provide FRO with a copy of proof of insurance and registration, if applicable, for that vehicle. The Permit Holder agrees to maintain said insurance and registration throughout the term of this Event Access Permit and to provide FRO with updated proof of insurance and registration during the term of this Event Access Permit.
  7. The Permit Holder is encouraged to report to FRO any person that he or she observes trespassing on the Event Location; provided however, Permit Holder agrees not to engage and/or interact with any person that he or she suspects of trespassing.
  8. The Permit Holder affirms that he or she is at least 12 years of age. If any Permit Holder is under the age of 18 years of age, the parent(s) or legal guardian of the Permit Holder shall join and co-sign this Event Access Permit.
  9. Participant Agreement, Release and Assumption of Risk. The undersigned Permit Holder agrees to execute that certain Participant Agreement, Release and Assumption of Risk and to abide all of the terms of said Participant Agreement, Release and Assumption of Risk, which the terms of said Participant Agreement, Release and Assumption of Risk are incorporated herein by reference. Further, said Participant Agreement, Release and Assumption of Risk shall remain in full force and effect after termination of this Event Access Permit and shall apply to any future entry, even unauthorized entry, onto FRO Properties.
  10. The Permit Holder agrees to comply with all applicable laws, rules and regulations of the Commonwealth of Pennsylvania, Foster Township, Cass Township, and any other municipality where the Permit Holder may access the Event Location only pursuant to this Event Access Permit. It is the Permit Holder’s responsibility to become fully familiar with said Ordinances and any changes and revisions made to said Ordinances after the date of this Event Access Permit. FRO and/or RAC is not responsible for any future ordinances, changes, and/or revisions, but rather said responsibility rests solely with the Permit Holder.
  11. Any Permit Holder who violates any laws, rules and regulations, be they Federal, State or Local, will have his or her Event Access Permit revoked and terminated without refund of any monies.
  12. The Permit Holder agrees to abide by the rules and regulations of FRO as such may be amended from time to time. In the event that the Permit Holder violates any rules and regulations of FRO as may be amended from time to time, the Permit Holder acknowledges, understands and agrees that his or her Event Access Permit will be revoked and terminated without refund of any monies.
  13. The Permit Holder consents to his person, off-road vehicle, coolers, and any bags being searched while on FRO Property by an authorized representative of FRO to ensure that the Permit Holder is complying with all conditions of the Event Access Permit including but not limited to the rules and regulations as may be amended from time to time by FRO.
  14. The Permit Holder warrants and represents that (a) the vehicle(s) that the Permit Holder are using is/are lawfully registered, inspected, and insured, and that Permit Holder has no knowledge of any condition that might render the vehicle(s) unsafe in any manner; (b) the Permit Holder is properly licensed and/or certified to operate the vehicle(s); (c) the Permit Holder is physically and mentally healthy and able to operate said vehicle(s); (d) the Permit Holder has no condition, physical and/or mental, that will put him/her and/or others at risk while on the Event Location and/or any other properties of FRO, RAC, and/or others; (e) the Permit Holder will not operate the vehicle(s) under the influence of alcohol, drugs, and/or any other substance; and (f) the Permit Holder will not bring alcohol, drugs, and/or any other illegal substances onto the Event Location together with any other properties of FRO, RAC, and/or others and/or will not provide any alcohol, drugs, and/ or any other illegal substances to any other individual including but not limited to minors.
  15. In addition to agreeing to wear a properly fitted and secured DOT or SNELL certified helmet as set forth in the separate Participant Agreement, Release, and Assumption of Risk, Permit Holder agrees to always wear a seatbelt and/or safety harness while operating and/or riding on any type of vehicle, ATV, motorcycle, UTV, dirt bike, and/or any other off-road vehicle. Permit Holder agrees to wear proper footwear. Failure to comply with any of the terms of this Event Access Permit, including but not limited to this paragraph, will result in the immediate termination and revocation of this Event Access Permit without any refund.
  16. Any Permit Holder, whose actions cause Foster Township, Cass Township, any municipality, or any governmental agency to cite, ticket or fine FRO and/or RAC shall have their Event Access Permit immediately terminated without refund of any monies. Further, the Permit Holder who causes such a citation agrees to indemnify FRO, RAC, and the other affected parties and said Permit Holder shall pay and be solely responsible for any and all fines, costs, and attorney’s fees incurred by FRO and/or RAC on account of said citation or ticket.
  17. This Event Access Permit shall be governed by the laws of Pennsylvania. The captions used herein are for the convenience of the parties. If any paragraph of this Event Access Permit shall be held unlawful, invalid, or enforceable, that paragraph shall be deemed deleted and without prejudice to the lawfulness, validity, and enforceability of the remaining paragraphs and sections. This Event Access Permit is binding on Permit Holder and his/her respective heirs, personal representatives, successors, and/or assigns. The Permit Holder agrees that the Court of Common Pleas in and for Schuylkill County, Pennsylvania shall exclusive jurisdiction and venue of any claims arising out of and/or related to this Event Access Permit and/or the Permit Holder’s use of the FRO Property.
  18. In the event that the Permit Holder is under the age of 18 years old, the undersigned parent(s) or legal guardian of the Permit Holder agrees to be bound to this Event Access Permit to the same extent as if they were the Permit Holder and further acknowledge and agree that they authorize the Permit Holder to enter into this Event Access Permit. The undersigned parent(s) or legal guardian certifies that he/she/they have legal responsibility of the Permit Holder. Further, the undersigned parent(s) or legal guardian consents to Permit Holder agreeing to the terms and conditions set forth in in this Event Access Permit. Further, the undersigned parent(s) or legal guardian of Permit Holder consents and agrees to be bound by all terms of the Event Access Permit for himself/herself/ and their respective heirs and/or the heirs of the Permit Holder.
  19. If you leave Event Location and trespass onto other properties without permission from property owner including but not limited to FRO and/or RAC, this is illegal. If caught trespassing along Railroad tracks railroad takes this trespassing very seriously and you may face summary citations, criminal charges, impoundment of vehicle, and be subject to restitution costs for any damages or delays to railroad property or operations. If caught trespassing railroad police will notify FRO personnel and you may face having your permit revoked. I/We have read, understand, and agree to the terms and conditions set forth above and by my/our signature below, I/we, intending to be legally bound, agree to the terms contained hereon on my/our respective behalf and on behalf of the Permit Holder, and our respective personal representatives, heirs, successors and/or assigns.

PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK

In consideration of the services of Famous Reading Outdoors LLC, their agents, owners, officers, landlord, Reading Anthracite Company, affiliated and/or related entities, property owners and their respective owners, shareholders, insurers, representatives, successors and assigns, volunteers, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "FRO"), I hereby agree to release, indemnify, and discharge FRO, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

  1. I acknowledge that my participation in ATV, UTV, dirtbiking, and other motorized activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.

The risks include, among other things: the possibility of rough terrain, slips and falls; passengers can be jolted, jarred, bounced, thrown about and otherwise shaken during rides; collision with fixed or movable objects, vehicles, or other watercraft; boat capsize and entrapment; accidental drowning; water craft are slippery when wet and accidents can occur getting in or out; the forces of nature including extremes of weather, lightning and rapid weather changes, exposure to sun, strong wind, cold, large waves, eddies and whirlpools, tidal conditions, surf and currents; exposure to temperature and weather extremes which could cause cold water shock, hypothermia, hyperthermia (heat related illnesses), heat exhaustion, sunburn, dehydration; exposure to potentially dangerous wild animals, insect bites, and hazardous plant life; aggressive and/or poisonous marine life; musculoskeletal injuries including head, neck, and back injuries; wrist, arm, or shoulder injuries; equipment failure and/or operator error; the negligence of other visitors, participants, or other persons who may be present; improper lifting or carrying; my own physical condition, and the physical exertion associated with this activity; transmissible pathogen or disease; Traveling to and from activity locations raises the possibility of any manner of transportation accidents; accidents or illness can occur in remote places without medical facilities and emergency treatment or other services rendered.

Furthermore, FRO personnel have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction.

  1. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. Additionally, I agree to wear a properly fitted and secured DOT or SNELL certified helmet while participating in this activity.
  2. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless FRO from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of FRO’s equipment or facilities, including any such claims which allege negligent acts or omissions of FRO.
  3. Should FRO or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
  4. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
  5. In the event that I file a lawsuit against FRO, I agree to do so solely in the state of Pennsylvania, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against FRO on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at FRO. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.

RULES AND REGULATIONS

In order to maintain and keep a fun, save experience for all permitholders, Famous Reading Outdoors LLC (“FRO”) request that everyone follow our rules and regulations.

Failure to comply with any and all rules, regulations, and/or safe operating procedures may result in arrest, fines, revoking of your access permit on a temporary and/or permanent basis, and/or temporary and/or permanent banning using any area of FRO and/or participating in any future activities and/or events on any area of FRO. Further, a revocation of your access permit will result in the forfeiture of any permit costs together with any other expenses and/or fees paid to FRO.

USER RULES

  1. ALL ATV’S, UTVs, DIRT BIKES, SXS, AND OFF-ROAD VEHICLES NOT PERMITTED ON PUBLIC ROADWAYS MUST BE TRAILERED TO A DESIGNATED PARKING LOT OF FRO.
  2. All visitors to FRO must check in at the designated location at each designated parking area. As part of the check-in process, all persons, bags, coolers, and off-road vehicles will be checked by the security guard and motor vehicles/trailers may be checked as well.
  3. All visitors (both drivers and passengers) must have a valid and current FRO Permit, which must be on them at all times and/or a copy of said FRO Permit on an electronic device that is with each visitor at all times. Further, all visitors (both drivers and passengers) must have read, completed and signed the liability waiver that is part of the Access Permit.
  4. In addition to a copy of the Access Permit and other FRO related items such as your individual FRO barcode, FRO requires the following documentation to be on visitors at all times while on FRO Property:

    Full Sized Vehicles (License or Valid Photo ID, Registration & Insurance)
    ATV – All Terrain Vehicle (License or Valid Photo ID, Registration & Insurance)
    UTV – Utility Terrain Vehicle (License or Valid Photo ID, Registration & Insurance)
    Dirt Bike (License or Valid Photo ID and Insurance)
    Dune Buggy (License or Valid Photo ID and Insurance)
    Mountain Bike (License or Valid Photo ID)
    Hiking (License or Valid Photo ID)
    Hunting (License or Valid Photo ID)

  5. At least one person in each riding group must have a charged and working cell phone in their possession. FRO recommends that said cell phone have GPS and/or other location technology.
  6. No alcoholic beverages and/or illegal drugs on FRO Property.
  7. No one may be under the influence of alcoholic beverages and/or illegal drugs while on FRO Property.
  8. All visitors assume their own risk by entering FRO Property. Check all areas prior to proceeding and ride all areas with caution.
  9. Annual access permits do not include admission to special events. In the event of a special event, annual access permitholders may have access to other areas of FRO that are not part of the special event. All visitors shall abide with the directions of FRO and/or its personnel.
  10. All vehicles must operate in a manner to avoid incidents and/or accidents while in the area, including but not limited to maintaining a safe speed.
  11. The parking lot is for parking and unloading only with a maximum speed limit of 5 MPH. No speeding, tricks, or horseplay permitted.
  12. Firearms or weapons of any kind are prohibited except for approved hunters that use FRO Property during hunting season.
  13. Parking is permitted in designated parking areas only.
  14. Stay on marked trails. Stay within the posted area of FRO.
  15. Expect oncoming traffic and always be courteous and utilize proper trail etiquette.
  16. Camping is not permitted on FRO Property.
  17. All visitors are only permitted on FRO Property during the posted hours, which are seasonal and always during daylight hours. No overnight camping is permitting. No nighttime or overnight riding is permitted. No off-hour riding is permitting. If you are on FRO Property after hours, you will be considered a trespasser and FRO may charge any trespasser in accordance with the applicable laws.
  18. Be respectful of FRO Property, FRO personnel and other visitors.
  19. Remove all litter and trash and dispose of in the designated areas in the designated parking areas.
  20. Must comply with all applicable laws, rules and/or regulations.
  21. Must obey all signs on FRO Property.

ATV, MOTORCYCLE, DIRT BIKES, DUNE BUGGEY, SIDE-BY-SIDE & UTILITY VEHICLE (UTV):

  1. Everyone must wear a DOT approved helmet and protective eye wear (goggles, face shield, glasses, etc.).
  2. Wear protective footwear. No open toes or sandals permitted.
  3. Recommended rider gear such as gloves, chest protector, long pants and long sleeve shirts.
  4. No passengers unless the unit is manufactured for the driver and a passenger.
  5. We recommend riding in groups of 2 (two) or more.
  6. The number of passengers carried on a side-by-side utility type vehicle shall be limited by the number of manufacturer’s installed seat belts.
  7. Must wear safety harnesses and/or seat belts.

FULL-SIZE VEHICLES SAFETY REQUIREMENTS:

  1. Must travel in groups of two or more.
  2. Proper roll-over protection for all passengers.
  3. Battery tie down (no bungee cords)
  4. Seat belts must be worn by everyone in the vehicles, fire extinguisher and trash bag for liquid spills.
  5. At least one tow point (example: tow hook or receiver hitch)
  6. Front and rear tow points are mandatory for the harder trails along with a winch and locker.

HUNTING:

  1. All hunters must have a valid and current hunting license with them at all times.
  2. Hunting is permitted only in designated areas.
  3. No stands, tree stands, and/or any other structures are permitted to be erected by any hunter that has purchased an access permit.
  4. Must comply with all applicable laws, rules, regulations and guidelines.
  5. Hunting is only permitted during designated times and in designated locations.

MOUNTAIN BIKING:

  1. Must wear all safety gear including a proper and certified biking helmet.
  2. Must ride in pairs of at least two (2) individuals and must have a fully charged cell phone on them at all times.

PROHIBITED ACTIVITIES:

  1. Starting or maintaining a fire.
  2. Damaging or removing, in whole or in part, a living or dead tree, shrub or plant.
  3. Damaging, or removing rock, shale, sand, clay, soil or other mineral product, natural object or material.
  4. Feeding wildlife.
  5. Dumping, litter, trash, refuse, garbage, bottles, or pollutants.
  6. Disorderly conduct of any kind.
  7. Entering the property prior to sunrise. Remaining on the property after sunset.
  8. Camping overnight and/or riding between sunset and sunrise.
  9. Consuming any alcoholic beverages and/or illegal drugs.
  10. Being under the influence of alcohol and/or illegal drugs.

FAILURE TO COMPLY WITH FRO RULES, REGULATIONS AND SAFE OPERATING PROCEDURES MAY RESULT IN ARREST, FINES, TEMPORARY OR PERMANENT BANNING FROM USING THE FRO PROPERTIES, the FACILITY, and/or temporary and/or permanent revocation of your access permit and/or access privileges without refund.

FRO RESERVES THE RIGHT TO AMEND, MODIFY, AND/OR CHANGE THE RULES AND REGULATIONS FROM TIME TO TIME.

INSURANCE REQUIREMENTS

I certify, warrant and represent that I will maintain insurance with a minimum policy amount of $100,000 with a reputable insurance company authorized to do business in Pennsylvania on any vehicles I intend to use pursuant to the Access Permit. I agree to maintain such insurance throughout the term of the Access Permit. I agree to have proof of insurance on my person at all times while on FRO Property and/or using the Access Permit.

FOSTER TOWNSHIP AND CASS TOWNSHIP ATV Ordinances

FOSTER TOWNSHIP REGULATION

No person shall operate and no landowner or owner shall permit the operation of all-terrain vehicles on property in the Foster Township under the following circumstances at the following locations:

  1. No person shall park or store, nor shall any landowner permit to be parked or stored on any roadway, sidewalk or public ground within Foster Township any all-terrain vehicle.
    b. Upon a public highway, road or street, or on public parking lot not specifically designated for the use of all-terrain vehicles, except under the following situations.
    c. The supervisors, any police officer or law enforcement officer may authorize and limit the use of an all-terrain vehicle on a public highway or street when the need arises such as an emergency for transportation due to snow or other highway or special conditions.
    d. For groups of five or fewer all-terrain vehicles’ owner(s) and/or operator(s), on private property not owned, leased or under the control of the operator(s) unless the operator(s) have the express consent of the landowner, lessee or other person in control of the real property, except in the case of any emergency when other means of travel are not feasible or possible.
    e. For groups of six or more all-terrain vehicles, on any private property within the Township of Foster not zoned as a racetrack/recreational facility. Any all-terrain vehicle who engages in such use and any landowner who permits such use without proper zoning shall be fined a minimum of $300 per occurrence up to a maximum fine of $20,000, plus court costs and any reasonable expenses involved in the prosecution.
    f. For groups of six or more persons camping on land overnight for the purpose of operating all-terrain vehicles, unless the land on which they are camping is zoned a campground. The landowner must provide restroom and trash collection facilities at the entrance(s) to the camping area(s) and meet all other requirements for land zoned as a campground. Any all-terrain vehicle operator who engages in such use and any landowner who permits such use without the proper zoning and/or facilities shall be fined a minimum of $300 per occurrence up to a maximum fine of $20,000, plus court costs and any reasonable expenses involved in the prosecution.
    g. At a speed greater than is reasonable and proper, having due regard for conditions then existing.
    h. During the hours from one-half hour after sunset to one-half hour before sunrise without displaying a lighted headlight and lighted tail lights.
    j. Unless such all-terrain vehicle is equipped with a muffler or baffle in good working order and in constant operation so that noise emission at fifty feet at right angles from the vehicle path under full throttle does not exceed 86 DBA (decibels on the “A” scale).
    k. Within one hundred (100) feet of a dwelling between 12:00 midnight and 6:00 a.m. at a speed greater than minimum required to maintain forward movement of the vehicle..
    l. In any areas on which public hunting is permitted during the season open to the taking of deer with firearms from 7:00 a.m. to 11:00 a.m. and from 2:00 p.m. to 5:00 p.m., except during an emergency or lawful enforcement purpose, to go to and from a permanent residence or hunting camp otherwise inaccessible by conventional wheeled vehicle or for the conduct of necessary work functions involving land and timber survey, communication and transmission line patrol and timber harvest operations, or on the operator’s own property or as an invited guest of any owner or person in control of the that property.
    m. While transporting a bow, unless unstrung, or a firearm, unless disassembled, and securely encased or equipped with and made inoperative by a key locked trigger housing mechanism.
    n. On or across a cemetery or burial ground.
    o. On a railroad right-of-way, except for railroad, public utility or law enforcement personnel while in the performance of their duties.
    p. Unless it has at least one headlight, one tail light and adequate brakes capable or stopping the vehicle.

Section 3 – ENFORCEMENT
In addition to any authority contained in the Pennsylvania Vehicle laws, any police officer of the Township or other appropriate law enforcement officer is authorized to issue a citation for each violation of this ordinance in the same manner provided for the enforcement of summary offenses before a District Justice under the Pennsylvania Rules of criminal procedure pursuant to 53 P.S sec 66601.

Section 4 – PENALTY
Except as otherwise provided above, any person, owner, landowner, partnership, corporation, or the partners or officers, thereof, who or which violates any of the provisions of township ordinance shall, upon conviction thereof is summary proceeding or upon verdict in a civil enforcement proceeding, be sentenced to pay a fine of no less than $1,000 per occurrence up to a maximum fine of $20,000, plus court costs and any reasonable expenses involved the persecution in accordance with the Civil Enforcement Procedure Ordinance of Foster Township.

Section 5 – IMPOUNDING /STORAGE
In addition to the penalties assessed in Section 4, all-terrain vehicle(s) used in violation of township ordinance may be impounded and placed in storage with all towing and storage costs to be incurred by the offender/owner of the all-terrain vehicle. The Township will only return the all-terrain vehicle following the recouping of the cost of impoundment.

CASS TOWNSHIP REGULATIONS
No personal shall operate and no owner shall permit the operation of an all-terrain vehicle under the following circumstances at the following location:

Section 204.1. No personal shall park or store, nor shall any property owner permit to be parked or stored on any roadway, sidewalk or public ground with in the Township of Cass any all-terrain vehicle.

Section 204.2. Upon a public highway or road, and used as farm or play areas, or street, or on a public or private parking lot not specifically designated for the use of all-terrain vehicles, except under the following situations:

Section 204.2.1. The supervisiors, any police officer or law enforcement officer may authorize and limit the use of an all-terrain vehicle on a public highway or street when the need arises such as an emergency for transportation due to snow or other highway or special conditions.

Section 204.3. On private property not owned, leased or under the control of the operator unless the operator has the express consent of the owner, lessee or other person in control of the real property, except in the case of any emergency when other means of travel are not feasible or possible.

Section 204.4. At speed greater than is reasonable and proper, having due regard for conditions then existing.

Section 204.5. During the hours from one-half hour after sunset to one-half hour before sunrise without displaying a lighted headlight and lighted tail lights.

Section 204.6. Unless such all-terrain vehicle equipped with a muffler or baffle in good working order and in constant operation so noise emission at 50 feet at right angles from the vehicle path under full throttle does not exceed 86 DBA (decibels on the “A” scale).

Section 204.7. Within 100 feet of a dwelling between 12:00 midnight and 6:00 a.m. at a speed greater than minimum required to maintain forward movement of the vehicle.

Section 204.8. In any areas on which public hunting is permitted during the season open to the taking deer with firearms from 7:00a.m. to 11:00 a.m. and from 2:00 p.m. to 5:00 p.m., except during an emergency or lawful enforcement purpose, to go to and from a permanent residence or hunting camp otherwise inaccessible by conventional wheeled vehicle or for the conduct of necessary work functions involving land and timber survey, communication and transmission line patrol and timber harvest operations, or on the operator’s own property or as an invited guest of any owner or person in control of that property.

Section 204.9. While transporting a bow, unless unstrung, or a firearm, unless, disassemble and securely encased or equipped with an made inoperative by a key locked trigger housing mechanism.

Section 204.10. On or across a cemetery or burial ground.

Section 204.11. On a railroad right-of-way, except for railroad, public utility or law enforcement personnel while in the performance of their duties.

Section 204.12. Unless it has at least one headlight, one tail light and adequate brakes capable of stopping the vehicle.

Section 205. Enforcement
In addition to any authority contained in the Pennsylvania Vehicle Laws, any police officer of the Township or other appropriate law enforcement officer is authorized to issue a citation for each violation of this ordinance in the same manner provided for the enforcement of summary offenses before a District Justice under the Pennsylvania Rules of Criminal Procedure Pursuant to 53 P.S. 66601.

Section 206. Penalty
Any person, partnership, corporation, bureau or utility, or the partners or officer thereof, who or which violates any of the provisions of this Article shall, upon conviction thereof in a summary proceeding or upon verdict in a civil enforcement proceeding, be sentenced to pay a fine in accordance with 1 Cass Code 107, Penalties.

Section 207. Impounding/Storage
In addition to the penalties assessed in Section 204, an ATV used in violation of this ordinance may be impounded and placed in storage with all towing and storage costs to be paid by the offender/owner of the ATV. The Township will only return an ATV that was impounded proven owner once all outstanding fines, assessments and costs have been verified as paid.

Section 208. Savings Clause
The Provisions of this ordinance are hereby declared to be severable. If any clause, sentence, paragraphs, section or subsection is declared void or inoperable for any reason by any Court, it shall not affect any other part of portion than the part declared void or inoperable.
